Haití pide a UE indagar sobre la sentencia de tribunal de RD

Haití sugirió a la Unión Europea (UE) el envío de una misión a República Dominicana, para que indague sobre un fallo que establece las condiciones para acceder a la nacionalidad en su vecino país, durante un encuentro realizado esta semana entre diplomáticos europeos y el canciller haitiano Pierre Richard Casimir.

En la reunión, que se llevó a cabo el pasado lunes, Casimir recordó el “papel conciliador que siempre ha jugado la UE en cuestiones de migración entre Haití y República Dominicana”, y manifestó que el apoyo de Europa a la posición haitiana en este tema servirá para fortalecer a ciertos sectores dominicanos que se oponen abiertamente a la sentencia.

Según un comunicado de la Cancillería conocido el martes, el encuentro se realizó por iniciativa del representante de la Unión Europea en Haití, Javier Niño Pérez, quien estuvo acompañado por los embajadores de Alemania, Francia y España, así como el encargado de negocios del Reino Unido, entre otros diplomáticos.

Niño Pérez expresó su preocupación por las posibles consecuencias de la sentencia que rechaza Haití porque considera que afectaría a miles de dominicanos de ascendencia haitiana, y saludó la forma en que el gobierno haitiano ha manejado el asunto, en particular el enfoque de la diplomacia haitiana que “alienta la apertura, la comprensión y el respeto” entre los dos países.

De acuerdo con la nota de la Cancillería, el representante de la UE fue encargado por Bruselas para reunirse con el Ministro de Relaciones Exteriores y expresar el apoyo europeo a la posición del gobierno de Haití, además de remitir sus conclusiones a las más altas autoridades del bloque.

El Tribunal Constitucional falló en septiembre que la dominicana de ascendencia haitiana Juliana Deguis Pierre no tiene derecho a la nacionalidad de este país, porque nació de padres cuya condición de “extranjeros en tránsito” (sin residencia legal) la excluye de optar por ese derecho. Haití llamó a consulta a su embajador en Santo Domingo, Fritz N. Cinéas, y convocó al embajador dominicano en Puerto Príncipe, Rubén Silié Valdez, a quien le expresó su “desacuerdo y preocupación” por el dictamen.

Casimir aseguró en el encuentro del lunes que su país quiere evitar cualquier tipo de confrontación, y reiteró la posición de su gobierno contra el dictamen del TC, aunque reconoció que éste involucra a ciudadanos dominicanos.

Dominican Republic ruling is callous and insensitive, says St Lucia PM

Saint Lucia’s Prime Minister Dr Kenny Anthony has joined other regional heads in condemning a recent ruling by the Dominican Republic Constitutional Court that denies citizenship to persons born in the Dominican Republic, who are of Haitian descent.

During a lecture delivered at the University of the West Indies, Cave Hill Campus, on Tuesday, October 29, 2013, Anthony referred to the ruling as a “most callous and insensitive invective of people based on their ancestry.”

Anthony further stated, “It can never be right that persons who are born in a country can be denied the right of citizenship within that same country. What this September 23rd ruling by the Dominican Republic’s Constitutional Court has effectively done is to banish hundreds of thousands of persons who were born on Dominican soil and to relegate them to a stateless existence. Many of these people speak Spanish, not Haitian Creole.

“These barriers to people cause only harm, only discord and only perpetuate division. They cannot in any way be a step towards integrating the Caribbean as a community.”

Since the September 23, 2013 ruling, many regional and international organizations have expressed concerns about the effects of the implementation of such a ruling.

It is estimated that some 210,000 Dominican-born people of Haitian descent who were legally considered Dominican and contributed, as citizens of the Dominican Republic, to the growth and development of their society, economy and politics, would be rendered stateless.

Primer Ministro de Trinidad y Tobago también cuestionó el fallo contra migrantes

PM monitoring Dominican Rep, Haiti situation

Prime Minister Kamla Persad-Bissessar says she will monitor the situation in the Dominican Republic and will consult Caricom’s secretary general Irwin La Rocque and the Caricom Bureau on the best way forward to finding a resolution to the matter. She made the comment after UWI-based arts group Jouvay Ayiti visited her St Clair office, Port-of-Spain, yesterday to deliver a petition with over 800 signatures from the Caribbean and its diaspora calling for trade and other embargoes to be placed on the Dominican Republic.

 

The group has added its voice to global calls condemning the September 25 ruling by the Dominican Constitutional Tribunal which rendered many Dominicans of Haitian descent stateless. The group donned J’Ouvert-like costumes, such as moko jumbies, devils and bookmen, during yesterday’s action and also delivered the petition to the Dominican Embassy at Queen’s Park West, Port-of-Spain, before ending at the PM’s office.

 

In a release to the media last evening, the office said the PM acknowledge receipt of the petition “in support of Dominicans of Haitian descent, following the September 2013 ruling of the Constitutional Court of the Dominican Republic, which strips Dominican citizenship from immigrants entering the country since 1929 and that of their offspring.

 

“Mrs Persad-Bissessar has noted with great concern the issues raised in the letter. She recognises the difficulty and uncertainty that those persons in the Dominican Republic whose status and rights have been cast in doubt now face. “Equally, the Prime Minister respects the sovereign independence of the Dominican Republic and of its Constitutional Court,» the release said. The ruling, according to Jouvay Ayiti’s petition, has outraged the international rights community.

 

The group’s director, Rawle Gibbons, defined the Dominican Republic’s ruling as outrageous and said a dangerous precedent had been created. Caricom, he said, had a primary responsibility to respond to the issue, adding a «weak kind of statement» had been made but that was late and ineffectual. However, Dr Jose Serulle Ramia, ambassador for the Dominican Republic to Trinidad, said claims that approximately 300,000 Haitian descendants would be deported from the country in the wake of the ruling were false.

 

Instead, he said, the Haitian descendants have been given two years to regularise. He invited Persad-Bissessar to send a delegation to observe the regularisation process. Deportation, he said, was only applicable to those entering the country now in an illegal way.

 

Asked about calls for the country’s application to Caricom/Caribbean Development Bank to be reviewed and a trade embargo placed on the country, Ramia said Caribbean countries were like brother and sister and should not act like enemies. He said those proposals were against the solidarity of the peoples of the Caribbean.

La Junta Electoral presentará hoy el informe sobre el registro de extranjeros

El Presidente de la Junta Central Electoral presentará este jueves al país el informe definitivo del levantamiento realizado en el Registro Civil para determinar la cantidad de extranjeros inscritos de forma regular o irregular en todo el territorio nacional.

La Dirección de Comunicaciones de la Junta Central Electoral está convocando a una rueda de prensa del doctor Roberto Rosario Márquez, este jueves a las 11:00 de la mañana en la sede central de la institución, donde además participarán los Miembros de la Comisión de Veedores u observadores de este proceso, encabezada por el doctor Adriano Miguel Tejada, director del matutino Diario Libre.

La noche de este miércoles, la Comisión de Oficialías de la Junta Central Electoral, que coordina el doctor César Francisco Féliz Féliz, Miembro titular, y el personal que ha trabajado en este levantamiento a nivel nacional, concluyeron el trabajo, y se procedía a la elaboración del informe final que el doctor Roberto Rosario Márquez presentará al Consejo Nacional de Migración y al Presidente de la República, Licenciado Danilo Medina.

Además del doctor Adriano Miguel Tejada, quien la coordina, la Comisión de Veedores u observadores la completan los comunicadores Freddy Sandoval, Mario Rivadulla y Leonardo Aguilera. Además el Vicepresidente ejecutivo del Consejo Nacional de la Empresa Privada, Conep, doctor Rafael Paz.
